Landlord & Tenant

In the field of Landlord and Tenant, Rana has experience acting on both sides of commercial and residential disputes. She has acted for the tenant in high-value possession proceedings concerning a prime central London property, where substantial rent arrears of nearly £1,000,000 were in issue and the claim engaged questions of contractual forfeiture.

She has also acted for a landlord in contested proceedings under the Landlord and Tenant Act 1954, opposing a commercial tenant’s application for renewal of a business tenancy on grounds including the tenant’s failure to comply with its repairing obligations as evidenced by a detailed schedule of dilapidations, and the landlord’s intention to occupy the premises for its own business purposes, supported by listed building consent obtained for proposed redevelopment works.

Commercial Litigation

Furthermore, Rana has acted for clients in contractual disputes arising from service agreements, including matters involving complex issues of repudiatory breach, prevention of performance, and the recoverability of consequential losses under contractual limitation clauses.

Rana acted for the claimant in high-value commercial proceedings arising from a longstanding supply agreement between businesses in the electronics manufacturing sector, in which the defendant failed to pay a substantial number of outstanding invoices totalling a six-figure sum. The matter involved issues of contractual formation, variation, and debt recovery, and was successfully settled.

Rana has also acted in construction disputes, including representing a respondent in Adjudication proceedings arising from a disputed payment application under a construction contract, where the referring party sought payment in excess of £167,000. The matter raised complex procedural and jurisdictional issues, including challenges to the adjudicator’s jurisdiction, the validity of the payment application, and whether a valid pay less notice had been served.

Further demonstrating the breadth of her commercial practice, Rana advised a client before the Financial Ombudsman Service following a major private health insurer’s withdrawal of cover for cancer treatment on the basis of alleged non-disclosure. The complaint involved the application of the Consumer Insurance (Disclosure and Representations) Act 2012 and was upheld, resulting in the removal of the exclusion, reassessment of claims in excess of £60,000, and an award of compensation for distress.

Insolvency

In insolvency, Rana has advised individual clients in complex bankruptcy proceedings spanning a number of years, in which the clients’ beneficial interest in a residential property had vested in the trustee in bankruptcy and substantial liabilities remained outstanding across the bankruptcy estates. Rana advised throughout, including in negotiations with the trustee in bankruptcy which resulted in a full and final settlement, the release of Land Registry restrictions, execution of deeds of assignment returning the property to the clients, and the management of potential additional creditor claims pending the trustee’s orderly release from office.
